1. Contract terms
By signing up and paying for your package through the website you are entering into a fixed term 1 year contract with Critical Point Critical Care Nutrition Consultancy (hereafter referred to as Critical Point) to receive the selected service bundle.
1.1.Once your 1 year contract expires you will have to renew it in order to continue receiving services.
1.2.If you choose not to renew the contract after 1 year, we cannot continue to charge you except for particular individual services upon request and according to quotations.
1.3. Unused clinical advisory/mentoring services cannot be carried over to the following contract, but are forfeited if unused within the 1 year period.
2. Cancellation Policy
This business provides electronic services. Once you have opened, activated or downloaded the site content and services they cannot be returned, especially where you have requested customised content/services. You can cancel your subscription at any time, but please take note of the following:
2.1. In line with the Electronic Communications and Transactions Act 25 of 2002, if you have used, activated or downloaded the electronic site content you are not entitled to any refund, subject to the provisions below.
2.2. Your subscription can be cancelled for a full refund within 7 business days of subscribing provided that you have not used, opened, or downloaded any content within that period.
2.3. Your subscription can be cancelled at any other time during the contract period by giving 20 business days notice, but you may incur penalties for doing so depending on the extent of the website material you have accessed and used up to that point.
2.4. In general, cancellation penalties are as follows:
2.4.1. For cancellations within 3 calendar months of activation of subscription, the penalty is 50% of the remaining value of the subscription.
2.4.2. For cancellations within 3-6 calendar months of activation of subscription, the penalty is 75% of the remaining value of the subscription.
2.4.3. For cancellations after 6 calendar months of date of activation of subscription, the penalty is equal to the remaining value of the subscription.
2.5. During the notice period you can use any remaining clinical advisory/mentoring hours still available to you, otherwise these will be forfeited.
2.6. Any refunds that may be due to you may take up to 15 business days to reflect in your account and are processed via a third party pay platform.
3. Protection of Personal Information
3.1. Critical Point does not collect or store any “special personal information” about you as defined in Section 26 of the POPI Act.
3.2. Critical Point does not keep a record of or have access to the banking details you use to pay for services via the third party payment platforms.
3.3. The personal information you use to create and use your subscriber account on the website is used only for the purposes of managing access to subscriber content and tracking your activity on the site for Continuing Professional Development audit purposes.
3.4. Your personal information is not used, sold, shared with or transferred to any other party, or used for any purpose other than the stated services of the Critical Point website.
3.5. Your personal information is available for you to see and edit in the Your Profile section of the website.
4. Intellectual Property
4.1. The coursework, clinical tools and other original materials are the intellectual property of Critical Point.
5. Disclaimer
5.1. Critical Point is an independent health care professional and scientific consultant in the discipline of clinical nutrition. Critical Point does not endorse, feature or promote any particular brand or product.
5.2. Critical Point does not claim to express the views of any particular institution, society or other professional body.
5.3. The Critical Point website is not intended to be used as a clinical advisory service/health professional service direct to patients.
5.4. Information provided on the website is, to the best of our knowledge, current at time of publication.
6. Termination
6.1. If this contract is abused by a subscriber, access to the website, its contents and its associated services may be terminated without advance notice, which may result in forfeiture of material/content associated with your account.
6.2. All terms of this agreement shall survive termination.
7. Notification of changes
7.1. Critical Point reserves the right to make changes to these terms and conditions at any time. You will be informed of such changes via the website. Your continued use of the website and its contents after changes have been made, and you have been notified of the changes constitutes your acceptance of the new terms of conditions.
